1. What These Terms Cover
These Terms of Service govern the website subscription service offered by b4Help ("we," "us," "our") at b4help.net. By requesting a website, reviewing a preview site we build for you, or subscribing to a plan, you agree to these terms. If you are agreeing on behalf of a business, you represent that you have authority to bind that business.
These terms apply to the subscription website service only. Consulting, CRM, and managed IT services offered at b4help.com are governed separately.
2. The Preview Period
You pay nothing until you approve the site. We design and build your website first and publish it to a private preview link. There is no deposit, no design fee, and no setup charge to reach this point.
You are under no obligation to subscribe. If you decide not to move forward, you owe us nothing and we take the preview site down.
The preview site remains our property and stays on our infrastructure until a subscription begins. Preview links are private but not secured against sharing, so treat the link as semi-public. We may remove an unclaimed preview site after 30 days without notice.
3. Plans and Billing
We offer two plans:
- Managed Website, $249 per month. Includes domain registration and renewal for one domain we register on your behalf.
- Bring Your Own Domain, $199 per month. You keep your registrar and we point your existing domain at the site.
Subscriptions are billed monthly in advance. The first charge is due when you approve the site and we take it live, and each renewal bills on that same day of the month thereafter. Billing and invoicing are handled through Invoice Ninja, and card or bank details are processed by its connected payment provider. We do not store your full payment card number.
If a payment fails, we will contact you and attempt to collect again. If an account remains unpaid 14 days past the due date, we may suspend the website until payment clears. Past due balances accrue interest at 1.5% per month, the maximum permitted under Massachusetts law.
We may change plan pricing with at least 30 days written notice to the email address on your account. Price changes never apply retroactively, and you may cancel before the new price takes effect.
4. Cancellation
You may cancel at any time by emailing contact@b4help.com from the address on your account. There is no contract, no minimum term, and no cancellation penalty.
Cancellation takes effect at the end of the month you have already paid for. Your site stays online for the remainder of that period. We do not refund partial months.
We may cancel your subscription with 30 days notice for any reason, or immediately if you breach Section 7. If we cancel without cause, we refund any unused portion of the current month.
5. What Happens to Your Site and Domain
When a subscription ends, the website goes offline. Hosting, SSL, forms, backups, and maintenance stop with it. The subscription pays for an ongoing service rather than a one-time deliverable, and the site files and any domain we registered for you remain ours by default.
Release option. On request, and for a one-time release fee, we will hand over the website files, transfer a domain we registered for you, or both. The fee reflects how long you subscribed, and we quote it when you ask. Email us and we will tell you the amount before you commit to anything.
Released files are delivered as static HTML, CSS, images, and content. We do not provide our build tooling, deployment configuration, or hosting infrastructure. Domain transfers are subject to your account being paid in full and to registrar rules, including ICANN's 60-day lock after registration or a prior transfer.
Your own content, meaning the text, photographs, and logo you supplied, remains yours throughout and after the subscription. You may take it with you at no charge.
Under the Bring Your Own Domain plan, your domain is always yours. We simply stop pointing it at our servers when the subscription ends.
6. Your Content and Responsibilities
You are responsible for the accuracy and legality of everything you ask us to publish, including business claims, pricing, licensing information, photographs, and logos. You confirm that you own or have permission to use any material you send us, and you agree to cover our costs if a third party claims otherwise.
You are responsible for keeping a current email address on your account, responding to requests we need answered to keep the site accurate, and complying with any regulations that apply to your industry's advertising.
7. Acceptable Use
We will not build or host sites for illegal activity, adult content, gambling, malware distribution, deceptive financial offers, or content that harasses or defames a person or group. We may also decline work we consider abusive to us or to the people who read it. If a site crosses one of these lines after launch, we may take it down immediately and end the subscription without refund.
8. Maintenance and Service Levels
Your subscription includes hosting, SSL renewal, nightly backups, and ongoing content updates such as revised hours, new photographs, added services, and price changes. Email your request and we complete it in the normal course of business, typically within two business days.
Maintenance covers edits to the existing site. A full redesign, additional pages beyond the original scope, or a new feature is quoted separately and added to your monthly total by agreement.
We aim for continuous availability but do not guarantee uninterrupted service. Hosting, DNS, certificate authorities, and internet infrastructure occasionally fail, and scheduled maintenance may briefly interrupt access.
9. Add-on Services
Optional add-ons such as an AI chatbot, appointment scheduling, review management, Google Business Profile management, or blog content are quoted individually and added to your monthly subscription. You may drop an add-on at any time, effective at the end of the current billing month.
Regarding AI chatbots specifically: responses are generated by a probabilistic language model and may be inaccurate or incomplete. We do not warrant that AI-generated output is error free or free from bias. You are responsible for reviewing how the chatbot represents your business to your customers.
10. Intellectual Property
While your subscription is active and current, you hold a non-exclusive license to use your website for your business. We retain ownership of the site files, the design, our templates, our pre-existing code, and our methods, unless and until you exercise the release option in Section 5.
You retain ownership of your trademarks, logo, business name, photographs, and written content. We may display your website in our portfolio and marketing material unless you ask us in writing not to.
11. Limitation of Liability
To the maximum extent Massachusetts law permits, b4Help is not liable for indirect, incidental, or consequential damages, including lost profits or lost data, arising from downtime, failures of third-party platforms and providers, or security incidents outside our reasonable control. Our total liability for any claim is limited to the amount you paid us in the three months before the claim arose.
Nothing in these terms limits liability that cannot be limited by law.
12. Changes to These Terms
We may update these terms. If a change materially affects your rights, we will email the address on your account at least 30 days before it takes effect. Continuing your subscription after that date means you accept the revised terms.
13. Governing Law
These terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict of law rules. Any dispute will be resolved in the state or federal courts located in the Commonwealth of Massachusetts, and both parties consent to the jurisdiction of those courts.
